NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 13, 2000, executed by Borrower(s), Eddie D Cook and Peggy Cook, to Alan H. Larrick, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5003, Page 2961, and re-recorded in Book 5004, at Page 1390. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 126 Lickwater Road, Arnett, WV 25007. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 24, 2020, of record in the Clerk’s Office in Book 5071, Page 4667 and re-recorded in Book 5075, Page 3093. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

14th day of February, 2022
at 11:45 a.m.

The surface, together with any appurtenances thereunto belonging, of the following described tract or parcel of land, located in Marsh Fork District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:

BEGINNING at a stake which is on the southern boundary line of a road and the northern boundary line of the property hereby being conveyed, which stake is N 77deg. 07′ E 110.00 feet from the northwest corner of the property being hereby conveyed; thence S 77deg.07′ W 110.00 feet to a stake, which is the northwest corner of the property hereby being conveyed; thence S 04deg. 13′ W 113.61 feet to a stake; thence N 83deg.22′ E 110.00 feet to a stake; thence in a northerly direction through the property owned by the late Albert Cook, now owned by the parties of the first part, 126.00 feet back to the point of beginning. Being a tract of land 110 feet on the North, 113.61 feet on the West, 110.00 feet on the South and 126.00 feet on the East.

And being the same property acquired by Eddie D. Cook and Peggy Cook, his wife, by Deed dated March 10, 1995, from the heirs of Albert Cook and Edith Cook, his wife, recorded in the aforesaid Clerk’s Office on Roll 75, at page 93.

Further, and for the consideration aforesaid, Eddie D. Cook and Peggy Cook, hereby grant and convey a full and complete security interest in and to that certain manufactured home, described as a 1995, Clayton D/W manufactured home, with the respective serial number V3037744. It is understood and. agreed that the Trustee may proceed in accordance with West Virginia Code 46-9¬501 as to both the real and personal property in accordance to their rights and remedies in respect of the real property, upon the occasion of any default under the terms of this or any other agreement pertaining to the note hereinafter described

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
