Notice is hereby given that ERP Environmental Fund, Inc., 216 School Drive, Shrewsbury, WV, 25015, has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 40.74 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV, 25840, for renewal of Article 3 Permit Number U400591 to operate an underground mine in the Eagle seam of coal. The operation is discharging into Martin Fork of/and Peachtree Creek of March Fork of Big Coal River of Coal River of Kanawha River and Unnamed Tributaries of Clear Fork of Guyandotte River of the Ohio River and is located 3.5 miles northwest of Bolt in Marsh Fork District of Raleigh and Wyoming Counties, Longitude 81deg. 28′ 40″ and Latitude 37deg. 47′ 07″ (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until June 2, 2022, or thirty (30) days from date of final publication. A copy of the application will be available for review until June 2, 2022 or thirty (30) days from date of final publication in the DEP Regional Office located at the address above and is available at:
