ORDER OF PUBLICATION
TO DEFENDANTS LOWIE (EDDIE) LILLY AND HEATHER JOHNSON:
The purpose of this action is to collect on a legal debt in the amount of $11,124.86 plus interest and costs duly owed to Plaintiff, KELLY ENTERPRISES, INC. d.b.a. SERVPRO by and from Defendant, Lowie (Eddie) Lilly and Heather Johnson as Attorney in Fact of Lowie Lilly. Whereas, Plaintiff has performed remediation at the home owned by Lowie Lilly and his Attorney in Fact, Heather Johnson who is the Owner/Operator of River Expeditions in Oak Hill, West Virginia; and whereas, Defendants collected insurance payments allocated toward payment of this debt; and whereas Defendants have failed to forward the allocated insurance proceeds to Servpro to resolve the debt owed for services provided by Plaintiff.
It appearing that the Defendants have intentionally refused to accept service of this Complaint and Summons via attempted service by the Fayette County Sheriff Department and by attempted Individual Process Service after being made fully aware of the filing on the Complaint against them, it has become necessary to serve Notice by Legal Publication.
It is hereby ORDERED that Defendants do appear and serve upon KELLY ENTERPRISES, INC. d.b.a. SERVPRO, acting Pro Se in this matter, whose address is 416 City Avenue, Beckley, West Virginia, 25801 an answer or other defense to the civil complaint filed in this action before May 30, 2022, otherwise, judgment by default will be taken against him/her at any time thereafter.
A copy of said Complaint can be obtained from the undersigned Clerk at his office located at 222 Main Street, Beckley, WV 25801.
