The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 25, 2008, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5033, at Page 2491 and re-recorded in Book 5033, at Page 5430, Stephanie L. Sullivan a/k/a Stephanie Lively did convey unto Mike Day and Carl W. Roop, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described lot or parcel of land, together with all improvements thereon and easements and appurtenances thereto belonging, situate in Town District, Raleigh County, West Virginia, and being more particularly described as follows:

TRACT NO. 1:
Lot No. Twelve (12), Section 2, of the Walter James Subdivision No. 3, as the same is shown on a certain map titled “Plat Showing Section 2 of the Walter James Subdivision No. 3 on Secondary Route between Route 3 and Route No. 21, via Prosperity, Town Tax District, Raleigh County, West Virginia, Scale 1” – 100′, which said map is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map File 2, No. 176-A.

TRACT NO. 2:
Lot No. Six (6) on a certain map entitled “Plat Showing Section 1, of the Walter James Subdivision No. 3, on Secondary Route Between Route No. 3 and Route No. 21, via Prosperity, Town Tax District, Raleigh County, West Virginia, Scale 1″ – 100 Feet, Revised 1976”, which map is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 15, at Page 9. Reference is hereby made to said map for a more particular description of said lot or tract of land herein conveyed.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 106 Jamescrest Drive, Beckley, WV 25801.

AND BEING the same real estate which was conveyed to Stephanie L. Lively by Deed dated December 1, 1998, from Jerry W. Lively, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Microfilm Roll 148, at Page 1219.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
