NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated April 25, 2006, from Sharon D. Holt and Frank Holt to E. Dennis White, Jr., Trustee, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia on Roll No. 5022, at page 7, securing a promissory note in the principal amount of $94,071.93, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on June 1, 2022 at 1:30 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain parcel of land, together with the improvements thereon and appurtenances thereunto belonging, located near Beckley, in Town District, Raleigh County, West Virginia, being Parcel “C”, a part of a tract of land containing 18.80 acres, said parcel bounded and more particularly described as follows:
BEGINNING at a P/K nail (set), being a corner of the Marion Deck Tolbert, et al tract of land and the Wm. P. Coffman and Garnette R. Coffman (523-249), parcel of land, at the right of way of Deck Lane; thence leaving Deck Lane, and with the boundary line of the said Coffman parcel of land; N 33 degrees 30′ W 115.00′ to a rebar (set), being a corner of the said Coffman parcel of land; thence with two (2) new lines through the said Marion Deck Tolbert, et al tract of land; N 07 degrees 51′ W 13.96′ to a fence post (marked), a new corner, thence; N 56 degrees 30′ E 109.96′ to a rebar (set), being the common corner of Parcels “B” and “C”; thence with the common line of Parcels “B” & “C”; S 33 degrees 30′ E 127.58′ to the point of beginning, containing 0.339 acres, more or less, as shown on a map entitled “Map Showing Proposed Partition of the Property of Marion Deck Tolbert, et al, being Parcels A, B & C, Containing 0.896 acres, part of a tract of land containing 18.80 Acres, Located Along Deck Lane, Near Beckley, Town District – Raleigh County, WV, September 11, 2000, Scale 1″ = 30′, ESI, Inc.”
Together with the concurrent use of a certain right of way on an existing 15 foot right of way, used for the purpose of ingress and egress, said right of way known as Deck Lane.
Being the same property conveyed from Wayne D. Tolbert and Gloria J. Tolbert, husband and wife, to Sharon D. Holt and Frank Hold (a/k/a Robert Franklin Holt), her husband, by Deed dated March 21, 2006, of record in the aforesaid Clerk’s office on Roll No. 5021, at page 5943.
Terms of sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
