NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 29, 2006, executed by Borrower(s), David R Collins and Amy M Collins, to J.W. St. Clair and William Levine, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5023, at Page 3711. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 176 Moody Ct, Fairdale, WV 25839. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 15, 2020, of record in the Clerk’s Office in Book 5076, Page 3161. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

17th day of June, 2022
at 11:45 a.m.

The surface of a certain tract of land situated on the waters of Rock House Fork of Maple Meadow Creek as shown upon a Map entitled “Map Showing Parcel 5.1 Tax Map 18 Moody Court (Route 15/21) Trap Hill District, Raleigh County, WV” by Appalachian Engineering & Surveying, Inc. Dated 7/6/06, and more particularly bounded and described as follows:
BEGINNING at a capped rebar at the northwest corner of the herein described tract, said rebar located S. 13deg. 46′ 35″ E. 302.06 ft. from a rebar in the southeast right of way line of Moody Court and the common corner of Boles Richardson and Kenneth Collins; thence through Parcel 5.1 for the next six calls: N. 70deg. 19′ 55″ E. passing the centerline of a 12 ft. right of way at 18.51 ft. and continuing for a total distance of 102.64 ft. to a capped rebar; S. 77deg. 10′ 12″ E. 353.46 ft. to a 26″ marked maple; S. 63deg. 18′ 17″ W. 298.67 ft. to a capped rebar in center of maple cluster; N. 58deg. 39′ 44″ W. 75.59 ft. to a 16″ marked poplar; N. 50deg. 14′ 25″ W. 109.88 ft., to power pole no. 844D-171; N. 20deg. 21′ 22″ 73.09 ft., to the point of BEGINNING and containing 1.14 acres more or less.
The Grantors further grant to the Grantees their heirs and assigns, “the right of free ingress and egress over the road which is now in existence and which leads from the county road to what was formerly the Timothy Bailey and Bessie Bailey home place, and which is now the home place of Eddie Charles Richardson and Lois Marie Richardson. The said right of ingress and egress is to be used in common with other persons having the right so to do, and the right of ingress and egress is not to be hampered or obstructed by any fence or gates or by objects placed on said road.”
The Grantors further grant to the Grantees a right of way which centerline of a 12 ft. right of way located Moody Court (Route 15/21) Trap Hill District, Raleigh County, West Virginia, in more particularly described as follows:
BEGINNING at a point in the southeast right of way line of Moody Court, said point located N. 46deg. 05′ 30″ E. 9.75 ft. from a rebar at the common corner of Boles Richardson and Kenneth Collins; thence leaving said right of way and through Parcel 5.1 for the next four calls: S. 31deg. 21′ 29″ E. 234.32 ft. to a point; S. 14deg. 41′ 08″ W. 35.77 ft. to a point; S. 25deg. 52′ 58″ W. 40.89 ft. to a point; S. 03deg. 32′ 52″ W. 39.31 ft. to a point in the northern line of the above described tract.
Being the same property conveyed by Kenneth Randall Collins and Rebecca Ann Collins to David R. Collins and Amy M. Collins by deed dated July 11, 2006, and recorded in Book 5023, at Page 3707, in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
