Notice is hereby given that Nicholas Contura, LLC, P.O Box 707, Jerry Fork Road (Route 19/21), Summersville, WV 26651 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of 443.44 acres in order to add an additional 7.61 acres of permit area consisting of 3.63 acres of disturbed area/overburden storage and 3.98 acres of mineral removal in the Cedar Grove seam of coal, with the entirety of the permit being in the Upper Winifrede, Middle Winifrede, Lower Winifrede, Chilton, Hernshaw Williamson, Upper and Lower Cedar Grove, Alma, Peerless, 2 Gas, Campbells Creek and Powellton seams of coal.
The proposed operation is discharging into Town Creek, unnamed tributaries (locally known as Bee Branch and Georges Branch) of Willis Branch all of Paint Creek; unnamed tributary (locally known as Reeds Branch) and Ewing Fork of Toney Fork of Clear Fork of the Big Coal River of Coal River all of the Kanawha River and is located 2.1 miles west of Pax in Plateau and Clear Fork Districts of Fayette and Raleigh County, Longitude 81deg.17’59” and Latitude 37deg.55’18”.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until July 14, 2022 or thirty (30) days from date of final publication.
