NOTICE
Notice is hereby given that Panther Creek Mining, LLC, 250 W. Main Street, Suite 2000, Lexington, KY 40507 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for an Article 3 permit for the surface disturbance of approximately 73.75 acres in order to operate and maintain a contour/surface mine with auger/highwall mining in the Eagle — Kanawha seam of coal.
The proposed operation is discharging into Left Fork and Right Fork of Armstrong Creek and Unnamed Tributaries of/and Armstrong Creek of Kanawha River and is located 3.1 miles southwest of Powellton in Valley District of Fayette County, Longitude 81deg. 19′ 39″ and Latitude 38deg. 02′ 49″.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until June 6th, 2022 , or ten (10) days from date of final publication. A copy of the application will be available for review until June 6th, 2022, or ten (10) days from date of final publication in the DEP Regional Office located at the address above and is available at:
