NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 8, 2006, executed by Borrowers, Thelma F. Chapman and Harold E. Chapman, to R. Vance Golden III, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 772, at Page 325. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2 N Grimmett Ave, Mount Hope, WV 25880. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 19, 2022, of record in the Clerk’s Office in Book 1067, Page 138. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

The land referred to in this policy is situated in the STATE OF WEST VIRGINIA, COUNTY OF FAYETTE, CITY OF MOUNT HOPE, and described as follows: TRACT NO. 1: THE EASTERN PART OF LOT NOS. 1 AND 2, NORTH BROWN, AS SHOWN ON A MAP OF THE DEEGANS ADDITION TO THE CITY OF MOUNT HOPE ON FILE IN THE OFFICE OF THE CLERK OF THE COUNTY COURT OF FAYETTE COUNTY, WEST VIRGINIA: BEING THAT PORTION OF LOTS NOS. 1 AND 2, NORTH BROWN, EAST OF A LINE BEGINNING AT A POINT IN THE DIVISION LINE OF LOTS NOS. 2 AND 3, A DISTANCE OF 70 FEET FROM THE NORTHEAST CORNER OF LOT NO. 2, THEN RUNNING PERPENDICULAR TO SAID DIVISION LINE OF LOTS NOS. 2 AND 3, MIDWAY BETWEEN THE TWO DWELLINGS NOW LOCATED ON LOTS NOS. 1 AND 2, TO THE RIGHT OF WAY LINE OF THE U. S. HIGHWAY 19 AND 21. THERE IS RESERVED FROM THE OPERATION OF THIS DEED A SMALL TRIANGULAR PARCEL OF LAND (FOR STREET PURPOSES) CONSTITUTING THE NORTHWEST END OF SAID LOT; THE TRIANGLE BEING FORMED BY EXTENDING IN AN EASTWARD DIRECTION THE DIVISION LINE OF LOTS NOS. 2 AND 3 OF THE DEEGANS SUBDIVISION, NORTH BROWN. TRACT NO. 3: ALL OF THE RIGHT, TITLE AND INTEREST OF THE SURFACE AND SURFACE ONLY OF THAT CERTAIN STRIP OR PARCEL OF REAL ESTATE, BEING PART OF WHAT WAS KNOWN AS GRIMMETT STREET, SITUATE IN THE UPPER END OF THE CITY OF MOUNT HOPE, FAYE1Th COUNTY, WEST VIRGINIA, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTHWEST SIDE OF GRIMMETT STREET, A CORNER TO THE SOUTHERN LINE OF A 9- FOOT EASEMENT FOR A ROADWAY DESCRIBED IN A DEED FROM GARRETT & MOSELY, INC. TO GENO S. MARTINA, DATED MAY 24, 1937, AND OF RECORD IN THE AFORESAID CLERK`S OFFICE IN DEED BOOK 85 AT PAGE 453; THENCE ACROSS GRIMMETT STREET IN THE EXTENSION OF THE SOUTHERN LINE OF SAID ALLEY TO LOT NO. 56 OF THE MOUNT HOPE LAND COMPANY ADDITION, THENCE IN A SOUTHEASTERLY DIRECTION WITH THE LINE OF LOT NO, 56 TO ITS INTERSECTION WITH THE RIGHT OF WAY OF THE STATE ROAD COMMISSION OF WEST VIRGINIA; THENCE WITH SAID RIGHT OF WAY LINE IN A SOUTHWESTERLY DIRECTION 15 FEET TO THE CORNER OF LOT NO. I OF THE W. E. DEEGANS ADDITION TO THE CITY OF MOUNT HOPE, NORTH BROWN, AND, WITH THE LINES OF LOTS NOS. 1 AND 2 OF SAID NORTH BROWN IN A NORTHWESTERLY DIRECTION TO THE PLACE OF BEGINNING

Being the same property conveyed to Thelma F. Chapman and Harold E. Chapman by the Deed dated October 23, 2000 and recorded in Deed Book 573 at Page 233 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
