Notice of Proposed Annexation of 10.04 Acres, by the City of Smithers
The City of Smithers has filed an application with the Fayette County Commission for the annexation by minor boundary adjustment pursuant to the West Virginia Code §8-6-5. A public hearing regarding the proposed annexation will be held on August 10, 2022 at 11:30 a.m. in the chambers for the Fayette County Commission on the first floor of the Fayette County Courthouse located at 100 Court Street, Fayetteville, West Virginia. This is a public hearing.
The complete amended application for annexation with map is available at the office of the Clerk of the County Commission for Fayette County located in the Fayette County Courthouse or at the Smithers city hall located at 2 Greyhound Lane, Smithers, West Virginia.
A summary of the City of Smithers’ plan for providing services to the additional territories is as follows:
1. There are currently no residents living in nor businesses located in the proposed areas for annexation.
2. Police protection in the areas proposed for annexation will be provided by the Smithers Police Department, the Fayette County Sheriff’s Department, and the West Virginia State Police.
3. Fire protection in the areas proposed for annexation will be provided by the Smithers Volunteer Fire Department with mutual aid from other area fire departments.
5. There are presently no public roads or streets in either area proposed for annexation and as such there is no need for street maintenance in either proposed area.
6. An approval of the proposed annexation should have no impact on fire protection and fire insurance rates in the areas proposed for annexation as there are no persons residing in either area and as there are no businesses located in either area.
7. The City of Smithers is seeking to annex the proposed area to expand the boundaries of the City with an eye toward future economic development and land conservation.

A tract of land situated along Cannelton Hollow Road, Valley District, Fayette County, West Virginia, being more particularly described as follows:
