NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 9, 2018, executed by Borrower(s), Philip C Evans, to Paul O. Clay, Jr. & Brandon Steele, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 995, at Page 281. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 77 Charlton Hts Rd, Charlton Heights, WV 25040. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 26, 2022, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

20th day of September, 2022
at 11:15 a.m.

All of the following described tracts or parcels of real estate situate in the Town of Charlton Heights, Valley District (formerly Falls District), Fayette County, West Virginia, numbered and designated as Lots No. 22 and 23, Block “E” as shown on a map of Charlton Heights, recorded in the Office of the Fayette County Clerk at Fayetteville, West Virginia, in Map Book 12 at Page 53, and being more particularly bounded and described as follows, to-wit: BEGINNING at a cross on a ledge in the North right of way line of a 40 foot street, a corner to Lots Nos. 21 and 22 in Block “E”, thence N 15 40` E with the line of Lot No. 21, 143.21 feet to a pin in a stone pile; thence N 85 58` E 74.42 feet to a cross on a shelf of the East side of a large flat boulder, and being the corner to Lots No. 24, thence with the line Of said Lot No. 24 S 4 2` E 150.00 feet to a pin in the North right of way line of said 40.00 foot street; thence with the street for two courses S 85 58` W 80.31 feet to a pin and N 74 20` W 45.00 feet to the beginning and containing 0.399 acres. And being the same property conveyed unto the party of the first part herein by deed of Cory Sean Ohse, et ux, dated the 9 day of March, 2018, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument. This instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deeds in the chain of title to the above described real estate.

Being the same property conveyed to Philip C Evans by the Deed dated March 9, 2018 and recorded in Deed Book 758 at Page 256 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
