The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 17, 2009, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50366322, in Book No. 5036, at Page 6322, Ronald E Wilson did convey unto Vance Golden, Attorney, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 01 – Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
All that certain property situate in the City of Beckley, Raleigh County West Virginia, described as follows
TRACT 1:
The surface with appurtenances thereto belonging of Lot No. 110 as shown on a map of Adkins Ville later called East Beckley now in the City of Beckley, Raleigh County, West Virginia, which map was made by Milton Curtis, dated March the 2nd 1902, and on record in Raleigh County Court Clerk’s Office, said lot fronts on east line of I street and running back east between lot No. 112 and an Alley to Raleigh Coal Company line.
TRACT 2:
That certain parcel of land situate in the City of Beckley, now designated as East Beckley, and formerly known as Atkinsville, Town District, Raleigh County, West Virginia, known as Lot No. One Hundred Twelve (112) as shown on a map of Atkinsville, which map is of record in the office of the Clerk of County Courth of said county in Map Book 3, at page 40-D. Said lot fronts on what was formerly known as Calloway Street and is now called “I” Street.

That certain real estate situate in Town District Raleigh County, West Virginia bounded and described as follows:

TRACT 4: (part of Lot 116)
The hereinafter described parcel situate in the County of Raleigh, Beckley District, bounded and described as follows:
BEGINNING at a stake in an alley, which stake is in the middle of a tract of land owned by Monroe H Johnson and Mildred Johnson, which stake is 38½ feet from where the western line of this lot intersects said alley, thence S. 29deg. 00′ W 38½ feet to a stake, which is a corner to the property owned by Coleman, thence with the Coleman line N. 62deg. 40′ W. 152.10 feet to a stake on “I” Street, thence with “I” Street N. 29deg. E. 40 feet to a stake, thence in a straight line back to the point of beginning approximately 152.05 feet to the beginning.
And being the same property acquired by Ronald E. Wilson, by deed dated August 4, 2009, from Naomi Gray, to be recorded in the office of the Clerk of the County Commission of Raleigh County West Virginia, prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 204 I Street, Beckley, WV 25801.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
