TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 26, 2004, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1015, at Page 50, Patrick James Broyles and Donna Broyles did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

November 8, 2022 at 10:00 AM

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in East River District, Mercer County, West Virginia, and more particularly described as follows:

“all of that certain tract or parcel of real estate designated as Lot 13 on a plat bearing the legent, “MAP SHOWING LOT LAY-OUT OF PAR. 160 T.M. 17 CHRISTIAN FORK ESTATES, COUNTY ROUTE 44/12 EAST RIVER DISTRICT, MERCER CO., WV DATED: 6/5/02 REVISIONS: 3/24/03 SCALE: 1″ = 60″”, which plat is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat No. 14969 A & B, and which lot is more particularly bounded and described as follows:
BEGINNING at a point on the eastern line of a 30-feet wide unnamed street as shown upon said Plat, said point being the southwestern corner of Lot 14; thence with the division line between Lot 14 and Lot 13, S. 86deg. 56′ 46″ E. 113.29 feet to a point, being the common corner of Lots 1, 2, 14 and 13; thence with the division line between Lot 2 and Lot 13, S. 16deg. 53′ 54″ W. 102.99 feet to a point; thence with the division line between Lot 12 and Lot 13, N. 86deg. 56′ 46″ W. 113.29 feet to a point on the eastern line of said 30-feet right of way; thence with same, N. 16deg. 53′ 54″ E. 102.99 feet to the place of BEGINNING.
This deed is made subject to a Declaration of Protective Covenants, Restrictions and Reservations for Christian Fork Estates of record in the aforesaid Clerk’s Office in Deed Book 844, at Page 712, and the set back line and easements set forth on said plat. Lot 13 shall only be allowed to contain one residential unit.
And being the same real estate conveyed unto Patrick James Broyles and Donna Louise Broyles from William Erps, Dana Pettrey and Sandra J. Pettrey by deed dated the 9th day of March, 2004, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 866 at Page 608.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 133 Lance St, Princeton, WV 24740.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
