Notice is hereby given that LEXINGTON COAL COMPANY, LLC, 1025 MAIN STREET, MILTON, WV 25541 has submitted an application with the Department of Environmental Protection (DEP), 1159 Nick Rahall Greenway, Fayetteville, WV, 25840 for a Phase 1 release on Permit Number S600988, issued for 766.8 acres.
The permit is located in Valley District of Fayette County, 2.1 miles northeast of Boomer, WV (nearest PO) on Boomer Branch of Upper Kanawha River.
Lexington Coal Company, LLC completed final reclamation on 3/22/2008 and is requesting release of 60 percent of the reclamation performance bond currently in the amount of $767,000.00.
Written comments will be received at the DEP address above until December 3, 2022, or thirty (30) days from the date of the final publication.
