The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 9, 1999, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50004863, in Book No. 5000, at Page 4863 and re-recorded in Document No. MOD 50692869, in Book No. 5069, at Page 2869, Howard A Guy and Anita L Guy did convey unto Dennis Broglio and Wendell Turner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wilmington Savings Fund Society, FSB, as Owner Trustee, for the NRPL Trust 2019-2 Mortgage-Backed Notes, Series 2019-2 to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Slab Fork District, Raleigh County, West Virginia, and more particularly described as follows:
The surface of that certain tract or parcel of land situate and lying in Slab Fork District, Raleigh County, West Virginia, and more particularly described as follows:
BEGINNING at a point on the East side of White Oak Street, a common corner with M.T. Pittensbarger and Sam Blackwell line; thence in a straight line 250 feet East to a stake; thence following the line of the Grave Yard northwest a distance of 120 feet to a stake; thence continuing along the line of said Grave Yard north 164 feet to a Hickory Tree; thence bearing at a right angle in an easterly direction a distance of 130 feet to a stake; thence north along the Lundy Hunt line a distance of 600 feet to a stake; thence proceeding southwest along the Ira McKinney line a distance of 416 feet to a Oak Tree; thence along the E.E. Ray line south 220 feet to a White Oak Tree; thence east a distance of 93 feet to a stake; thence along the eastern side of White Oak Street along the line of said street south a distance of 274 feet to the point of beginning, containing five (5) acres, more or less.
And being the same property conveyed unto Harvey M. Calvert and Madeline Calvert, his wife, by deed of E.E. Ray and Nellie Ray, his wife, dated the 13*day of July, 1959, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 388, at page 488. The aforesaid Harvey M. Calvert died testate on the 30* day of September, 1995, devising the property described herein to his wife, Madeline Calvert. The aforesaid Madeline Calvert-died testate devising all of her estate, real and personal and mixed, to her two (2) children, Diane C. Deweese (nominated and appointed as Executrix) and David Vince Calvert, each to share and share alike, in fee simple absolute.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 320 White Oak St, Sophia, WV 25921.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
