The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 28, 2003, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 684, at Page 236, Lorene Hudnall and Del Wyatt Hudnall did convey unto Todd Taylor and Dan Kennedy, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Montgomery (formerly Kanawha) District, Fayette County, West Virginia, and more particularly described as follows:
That certain lot or parcel of land situate in the City of Montgomery, Kanawha District, Fayette County, West Virginia, more particularly bounded and described as follows:
BEGINNING at a point on the South line of Fifth Avenue in the City of Montgomery, West Virginia, on original Lot No. 4, thence S. 16deg. 03′ W. 49.53 feet to a point on original Lot No. 4, thence S. 36deg. 85′ W. 11.35 feet to a point on original Lot No. 4, thence N. 72deg. 45′ E. 1.5 feet to a point Lot No. 4, thence S. 17deg. 15′ W. 25.75 feet to a point on the South line of original Lot No. 4, thence N. 72deg. 45′ W. 28.78 feet to the Southwest corner of original Lot No. 4, thence N. 17deg. 15′ E. 86 feet to the Northwest corner of original Lot No. 4, thence S. 72deg. 45′ E. 33.03 feet to the point of beginning, and designated as Lot C on that certain map entitled “Subdivision of Lots 4 & 5, Block 43,” which was prepared by W. R. Wise, R.P.E., which is recorded in the Fayette County Clerk’s Office in Map Book 250 at Page 374.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 123 Fifth Avenue, Montgomery, WV 25136.
AND BEING the same real estate which was conveyed to Lorene Hudnall and Del Wyatt Hudnall, by Deed dated December 1, 1992, from Nancy Kelly Cunningham and Clifford Cunningham, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 500, at Page 320.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
