COMMISSIONER’S
SALE OF REAL ESTATE

Pursuant to and by virtue of the Amended Order of the Circuit Court of Raleigh County, West Virginia entered on the 7th day of October, 2022, in the cause therein pending under the style of DARLENE SHELTON, CATHY STOVER, SKYLAR JAMES ADRICK SHELTON, PLAINTIFFS v. DIANA FARLEY, DELISA PATTON, DEFENDANTS, Case NO. CC-41-2022- C-63, Ed Bibb aka Edgar E. Bibb, III, the undersigned Special Commissioner, will offer for sale at the front door (Main Street entrance) of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, to the highest bidder on

the following described real estate:

That certain tract or parcel of land situate in Trap Hill District, Raleigh County, West Virginia, and more particularly bounded and described as follows:

BEGINNING at a set rebar on the right of way of West Virginia Route 3/27, a common corner to the property now or formerly of Jessie T. and Glenda G. Adkins and the property herein conveyed; thence with the right of way of West Virginia Route 3/27, N. 4deg. 11 ‘W 67.10 feet to a set RR spike in said right of way; then continuing with said right of way, N. 5deg. 14′ E 119.61 feet to another set rebar, a corner to the property herein conveyed and a 16-foot right of way heretofore granted to Ina Mantel by Paige Muovich and others; thence leaving West Virginia Route 3/27 N. 84deg. 50’E approximately 160 feet to a set rebar; thence S 1 27′ W
213.31 feet to a set rebar; thence with the line of Jessie T. and Glenda S. Adkins N 85deg. 09’ W 156.17 feet to West Virginia Route 3/27 and the point of beginning, containing ± 0.69 acres and being Tract “A” as shown on a map entitled “Subdivision of a 1.40 Acres Tract in the name of Ina Mantel near the Town of Eccles, Trap Hill District, Ral. Co. W. Va.,”: G.O. Bledsoe, Inc., dated October 1, 1979, which map is ofrecord in the Office of the County Clerk of Raleigh County, West Virginia, in Deed Book 619, at page 418-A and which map is incorporated herein by reference, together with the rights set forth in the hereinafter referenced deed to that certain 16-foot right of way shown on the hereinbefore referenced map.

And being part of the same property conveyed to Mary Cottle, now deceased, by Ina Mantel, widow and remarried, by deed dated October 14, 1989, and of record in the aforesaid clerk’s office Deed Book 619, at page 418.

The undersigned Special Commissioner reserves the right to continue such sale or to reschedule the same by posting on the front door of said Courthouse a Notice of such
continuance and new date and time and posting an additional Notice thereof in the hallway of the Raleigh County Courthouse. Terms of the sale are cash or certified funds in hand from the highest bidder or a ten percent (10%) deposit with the balance paid within thirty (30) days or a letter of credit from a financial institution with an office in Raleigh County, West Virginia, insuring such bid with the balance due and payable within thirty (30) days. The above described real estate will be sold by the undersigned Commissioner by auction to the highest bidder subject to the right of the Commissioner to reject all bids if, in the Commissioner’s opinion, they are inadequate.

Said real estate will be sold “as is” without any warranty by the undersigned Special Commissioner as to the title of this property, without any warranty as to the mechanical, electrical, plumbing and structural components of any improvements and without any warranties or representations as to the contamination or lack of contamination to the surface, substrata, or the premises of hazardous substances and/or petroleum and related by-products, hydrocarbons, radon, asbestos, urea fomrnldehyde and polychlorinated biphenyl compounds.

The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

This sale is made and accepted subject to all prior reservations, restrictions, exceptions, easements, covenants and conditions made by all predecessor in title, except those pertaining to race, color and creed.

Said real estate will also be sold subject to any and all taxes, assessments and liens for taxes, if any.

The subject property is situate in Trap Hill District, Raleigh County, West Virginia and is listed on the land books of Raleigh County in said district in the name of Darlene I. Shelton and others on Tax Map 7, Parcel 22. The property is reported to have a street address of 861 Shawnee Road, Eccles, West Virginia 25836.

THIS SALE IS SUBJECT TO THE APPROVAL AND CONFIRMATION OF THE CIRCUIT COURT.
