The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated September 13, 2018, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5068, at Page 3004, Jonathon W. Cain did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Slab Fork District, Raleigh County, West Virginia, and more particularly described as follows:
TRACT ONE:
BEING the surface, together with the improvements thereon, of Lot 1A of Subdivision of Lot 1 of the Town of Princewick, in Slab Fork District, Raleigh County, West Virginia and more particularly bounded and described as follows:
BEGINNING at a concrete marker on the southern Right of Way of West Virginia Secondary Route 36, said concrete marker being on the line of Lot 1 of the Town of Princewick; thence following said Right of Way along the arc of a curve with a chord bearing of S 37deg. 43′ E for a chord distance of 43.33 feet to a concrete marker at the intersection of the southern Right of Way of West Virginia Secondary Route 36 with the western Right of Way of West Virginia Secondary Route 29; thence following the Right of Way of Virginia Secondary Route 29 S 32deg. 27′ W for 62.90 feet to a point on the Right of Way of West Virginia Secondary Route 29, common corner of Lot 1 and Lot 68; thence leaving said Right of Way and going along the common boundary of said Lots 1 and 68 N 62deg. 30′ W for 44.96 feet (passing an iron pin at 12.0 feet) to an iron pin on the line of Lots 1 and 68; thence with a new line thought Lot 1 No. 35deg. 17′ E for 81.6 feet to the point of BEGINNING, containing 0.071 acre, more or less, said lot herein conveyed also being more particularly described on a map attached to that certain deed dated May 9th, 2022, and made a part thereof (designated as Schedule A) entitled “Property Map for Vivian Lucas, Princewick, W.V. TRACT TWO:
BEING the surface of that certain lot or parcel of land situate at Princewick Slab Fork District, Raleigh County, West Virginia, and being Lot 1B of the Subdivision of Lot 1 of the Town of Princewick (the original map of the Town of Princewick being of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 8, at page 242) as shown by a plat attached to that certain deed dated May 9th, 2002, and made a part thereof, designated as Schedule B, said lot or parcel being more particularly bounded and described as follows:
BEGINNING at a hub set in concrete on the southern side of the Right of Way of WV Sec. Rout 36, common corner of Lot 1 and Lot 2 of the Town of Princewick, thence following said right of way S. 58 degrees 13′ E. for 118.03 feet to a concrete marker on the line of Lot 1; thence leaving said right of way and with a new line thought Lot 1 S. 35 degrees 17′ W. for 81.6 feet to an iron pin on the common boundary line of Lot 1 and Lot 68; thence following the common boundary line of said Lots 1 and 68 N. 62 degrees 30′. for 137.8 feet to a hub, common corner of Lots 1, 2, and 68; thence going along the common boundary of Lots 1 and 2 N. 46 degrees 03′ E. for 95.60 feet to the point of BEGINNING, containing 10,440 square feet, more or less.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 109 Epperly Road, Princewick, WV 25908.
AND BEING the same real estate which was conveyed to Jonathon W. Cain, by deed dated September 13, 2018, from Rebecca L. Cain and Richard W. Cain, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book, 5068 at Page 3003.
The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
