Notice is hereby given to Louemma Saunders’ Unknown Heirs, Allen Saunders, Antwaun Saunders, Christina Saunders, Cecilia Marino’s Unknown Heirs, Sheila V. Ford’s Unknown Heirs, Danielle Ford, David Ford, Erica Ford, Linda Marino’s Unknown Heirs, Jasmine Suzanne Marino, Frances Cohen’s Unknown Heirs, Shawn Cohen, Latrisha Cohen, Joe Curtis Cohen, Tony Cohen, James D. Saunders’ Unknown Heirs, Janice Faye Saunders, Emma Culpepper, Dreama L. Hunt aka Dreama L. McNichols’ Unknown Heirs, Christopher T. Hunt, Kenneth D. Saunders, Douglas Saunders’ Unknown Heirs, Unknown Persons/Owners, and Scott F. VanMeter, Sheriff of Raleigh County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Raleigh County, West Virginia, and is known as Civil Action No. CC-41-2022-C-396, and styled AEP West Virginia Transmission Company, Inc. vs. Louemma Saunders’ Unknown Heirs, et al.
Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate in Trap Hill District, Raleigh County, West Virginia, identified as Tax Map 3, Parcel 23, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 582, at page 504, and bounded and described as follows:
SUR 14.95 AC MILLERS CAMP BR
F Beginning at a chestnut a corner to G. W. Cottle; thence with same (as surveyed by G. F. Wilson, allowing 45′ variation) N 29 15´ W 214.5 feet to two maple sprouts; N 53 00´ W 495 feet to a white oak, a corner to Lot No. 6; and with same N 67 45´ W 340 feet to a stake; S 78 46´ W 205.5 feet to a stake; S 61 31´ W 246.5 feet to a stake, corner to Lot No. 5; with same S 50 01´ W 146.6 feet to a stake; S 25 11´ W 169.4 feet to a stake corner to Lot No. 8; and with same (by Protraction) S 73 20´ E 1320 feet to a stake in a line of the original survey; and with the same N 37 45´ E 195 feet to the beginning, containing 14.95 acres.
The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Raleigh County Circuit Clerk’s office at the Raleigh County Judicial Center, 222 Main Street, Beckley, West Virginia, 25801, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301.
The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on February 2, 2023, at 1:00 p.m., in the Circuit Court of Raleigh County, West Virginia, located at the Raleigh County Judicial Center, 222 Main Street, Beckley, West Virginia, 25801, before the Honorable Harry Kirkpatrick. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
