Notice is hereby given that NEWGATE DEVELOPMENT OF BECKLEY LLC, 302 SOUTH JEFFERSON STREET, ROANOKE, VA 24011 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 197.72 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number S301411 to operate a surface and Highwall Mine in the Beckley and Lower Beckley seam of coal.
The operation is discharging into Unnamed tributaries of Bailey Branch and Bailey Branch; unnamed tributaries of Mill Branch and Mill Branch; all of Winding Gulf of Guyandotte River of Ohio River and is located 1.9 miles, North of Helen in Slab Fork District of Raleigh County, Longitude 81o 18′ 48″ and Latitude 37o 39′ 36″ (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conferency of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until March 20, 2023, or thirty (30) days from the date of final publication.
