TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 20, 2017, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5065, at Page 7862, John T. Fields did convey unto Mary E. Page, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

March 2, 2023, at 1:22 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows:

All that certain parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Beckley, Raleigh County, West Virginia, and being more particularly bounded and described as follows:

A certain lot or parcel of land and easement, together with all improvements thereon and appurtenances thereunto belonging, located in the City of Beckley, Raleigh County, West Virginia, in Park Heights, a map of which is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 8, at page 95, and described as follows:

First: All of the surface of a part of Lot 135, Park Heights, and which said property hereby conveyed is bounded and described as follows:

BEGINNING at a stake on Dorcas Avenue, a common corner of Lots 135 and 136; thence with the division line between Lots 135 and 136, N. 66deg. 34′ W. 138.6 feet to a stake; thence N. 23deg. 26′ E. 37.5 feet to a stake; thence through Lots 135, S. 66deg. 34′ E. 138.6 feet to a stake on Dorcas Avenue; thence with Dorcas Avenue S. 23deg. 26′ W. 37.5 feet to the beginning.

Second: The following easement located over a part of Lot No. 135, Park Heights, and being more particularly bounded and described as follows:

BEGINNING at a stake on Dorcas Avenue, a common corner of Lots 134 and 135, N. 66deg. 34′ W. 138.6 feet to a stake; thence S. 23deg. 26′ W. 12.5 feet to a stake; thence through Lot No. 135 S. 66deg. 34′ E. 138.6 feet to a stake on Dorcas Avenue; thence with Dorcas Avenue N. 23deg. 26′ W. 12.5 feet to the beginning.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 230 Dorcas Avenue, Beckley, WV 25801.

AND BEING the same real estate which was conveyed to John T. Fields, by Deed dated July 20, 2017, from Joshua D. Humphrey, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5065 at Page 7861.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
