The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 11, 2020, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 1396, at Page 394, Isis Wallace did convey unto Harold Wolfe, Esquire, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

March 2, 2023, at 12:02 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Bluefield District, Mercer County, West Virginia, and more particularly described as follows:

“All that certain lot or parcel of land with appurtenances and improvements thereon situate in the City of Bluefield, Mercer County, West Virginia, being the western portion of Lot No. 1, Section 974, of said City of Bluefield, and more particularly bounded and described as follows, to-wit:

BEGINNING at a point in the southern line of Memorial Avenue (formerly Springdale Avenue), S. 61 deg. 30′ W. 250.46 feet distant from the point of intersection of the southern line of said Avenue with the western line of Clovis Street ; thence leaving said Memorial Avenue, S. 31 deg. 40′ E. 150.73 feet to a point in the northern line of Lot 2, Section 974; thence along and with the northern line of said Lot 2, S. 58 deg. 20′ W. 49.92 feet to a point in the eastern line of original Lot 3, Section 968; thence along the eastern end of a portion of Lot 3 and all of Lots 2 & 1, Section 968, N. 31 deg. 40′ W. 153.49 feet to a point in the southern line of Memorial Avenue; thence along and with the southern line of said Avenue, N. 61 deg. 30′ E. 50 feet to the point of BEGINNING.”

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 410 Memorial Avenue, Bluefield, WV 24701.

AND BEING the same real estate which was conveyed to Isis Wallace by Deed dated April 11, 2020, from Courtney Samanta Mabry f/k/a Courtney Samantha Andrews, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1091, at Page 412.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
