TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 31, 1999, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5000, at Page 6692 and rerecorded in Deed of Trust Book 5001, at Page 7805, Walter W. Ashley did convey unto John Ballengee, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

March 2, 2023, at 1:24 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows:

The surface of that certain lot or parcel of land situate in the Ewarts Heights Addition to the City of Beckley, Raleigh County, West Virginia, as shown on a map of said addition marked “Revised Map of Part of Ewart Heights Addition, Beckley, West Virginia, P. H. Wilson, End. September 18, 1945”, a copy of which map is attached to a deed recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book 215 at Page 55, and the property hereby conveyed is LOT NUMBER EIGHT (8) of Section 7, as set forth on said map.

There is hereby EXCEPTED and RESERVED from the above conveyance, a part of Lot Eight (8), Section Seven (7) of the Ewart Heights Addition to the City of Beckley, West Virginia, as recorded in a Deed in the aforesaid Clerk’s Office in Deed Book 610, at Page 254.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 106 Stewart Avenue, Beckley, WV 25801.

AND BEING the same real estate which was conveyed to Walter W. Ashley by Deed dated August 26, 1999, from Della Rae Whitt, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5000 at Page 6691.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
