NOTICE OF TRUSTEES SALE
In execution of the deed of trust, dated July 20, 2005, from Samuel G. Boothe and Anita D. Boothe to Ottice R. Adkins and Carl W. Roop, as trustees, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5018, at page 9999, the undersigned trustee will offer for sale at public auction on March 14, 2023, at 11:00 a.m., at the Main Street entrance of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, a tract or parcel of land being a 0.833 acre tract situated in the vicinity of Fairdale, Trap Hill District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:
BEGINNING at a 1/2 inch rebar, set, at the intersection of the western right of way line of Spanker Branch Road (West Virginia County Route 13/5) and the northern right of way line of CSX Transportation, Inc. railroad; thence leaving said right of line of Spanker Branch Road and with said right of way line of CSX Transportation. Inc. N. 69 degrees 03′ W 243.71 feet to a point, in the center of Spanker Branch; thence leaving said right of way line of CSX Transportation, Inc. and with new lines running with the center of Spanker Branch through James E. Cline the following two (2) calls: N 08 degrees 59′ W 129.19 feet to a point; thence leaving said Spanker Branch S 82 degrees 53′ E 248.08 feet (passing a 1/2 inch rebar, set on line, at a distance of 20.00 feet) to a 1/2, inch rebar, set, on the previously mentioned right of way line of Spanker Branch Road; thence with said right of way line of Spanker Branch Road S 00 degrees 30′ S 184.02 feet to the POINT OF BEGINNING and containing 36,266 square feet (0.833 acres), more or less, as surveyed by Eastern Surveying, Inc. in December, 1997, and shown on a plat attached hereto and made a part of this description.
And being a part of the same property acquired by Samuel G. Boothe and Anita D. Boothe, by Deed dated December 11, 1997, from James Elliott Cline and Phyllis A. Cline, husband and wife, which said deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 125, at page 635.
The deed of trust states that the address of this real estate is commonly known as 110 Spanker Branch, Fairdale, West Virginia 25839.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated January 27, 2023, of record in said Clerk’s Office in Book 5078, at page 9227.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by deed without any warranty, expressed or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
