The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 26, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50389042, in Book No. 5038, at Page 9042 and re-recorded in Document No. 50402042(REREC), in Book No. 5040, at Page 2042 and modified in Document No. MOD 50679335, in Book No. 5067, at Page 9335, Alvis Franklin Alderman and Charity Alderman did convey unto Larrick Law Office, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

Situate near Rock Creek, Marsh Fork District, Raleigh County, West Virginia, more particularly described as follows:

BEGINNING at a 5/8 inch diameter iron rebar (placed,) near the top of bank of Rock Creek, said 5/8 inch diameter iron rebar being a boundary corner on the eastern boundary line of Parcel 77.0, Tax Map 11 B (Lots 9 and 10, Brown Subdivision, Map Book 8, page 113, Sherman Bailey and Rosemary Bailey, Deed Book 685, page 736;) thence with the top of bank of said Rock Creek, South 35deg. 05′ 00″ East, 209.26 feet to a 5/8 inch diameter iron rebar (placed) approximately 8.1 feet north of and perpendicular to the centerline of an unnamed private dirt road; thence following the northerly side of said unnamed private dirt road, South 39deg. 33′ 07″ West, 139.56 feet to a fence post (found,) a common boundary corner of the subject with Parcel 21.1, Tax Map 17 (Harold D. Anderson and Linda Anderson, Will Book 24, page 7;) thence with a common boundary line of the subject property and said Parcel 21.1, North 39deg. 22′ 07″ West, 140.02 feet to a 5/8 inch diameter iron rebar (placed,) a common boundary corner of the subject property with said Parcel 21.1, said 5/8 inch diameter iron rebar also being a point on the easterly boundary line of Parcel 79.0, Tax Map 11B (Lots 12, 13, 14, and 15, Brown Subdivision, Map Book 8, page 113, Charles L. Dickens and Judy A. Dickens, Deed Book 756, page 851; thence following he easterly boundary line of said Parcel 79.0, Parcel 78.0, Tax Map 11B (Lot11, Brown Subdivision, Map Book 8, page 113, Sherman Bailey and Rosemary Bailey, Deed Book 685, page 736,) and said Parcel 77.0, North 18deg. 35′ 49″ East, 180.00 feet to the point of BEGINNING, containing 0.57 acres more or less as shown on a drawing entitled, “Boundary Survey for: Evelyn E. McKnight,” Project Number 01S-036, dated September 17, 2001, revised September 24, 2001, prepared by Jones & Jordan Engineering, Inc., Beckley, West Virginia. Map Roll 5010, Page 4895.

And being the same property acquired by Alvis Franklin Alderman and Charity Alderman, husband and wife, by deed dated March 26, 2010, from Evelyn E. McKnight, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 314 Upper Rock Creek Road, Rock Creek, WV 25174-9667.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
