This day came the Court, sua sponte, upon the issuing of a Second Amended Notice of Hearing in this matter, as to the Petition for Appointment of a Guardian and/or Conservator and a Motion to Withdrawal (of counsel for Petitioner Mark Sayre Pence). Said hearing is scheduled to occur remotely, via Microsoft TEAMS, before the Mental Hygiene Commissioner, Jane E.
Harkins, on April 20, 2023 at 1:30 p.m.; all persons wishing to participate remotely must contact the Court’s Clerk by Aptil 17, 2023, in order to receive the digital invitation.
The Court’s Mental Hygiene Commissioner reports counsel for Petitioner moved to withdraw after Petitioner stopped making contact with her, and Petitioner has also failed to respond to several other recent efforts to contact him, such that no one is confident of his contact information listed in the Petition and is unsure of his interest in carrying forth the Petition. While counsel has agreed to send the Second Amended Notice to Petitioner, as well as to those persons named in the Petition (Petitioner’s siblings, being Joseph Gordon Pence and Lynn Sandra Russell), via certified mail to the addresses identified in the Petition, the Mental Hygiene Commissioner recommends said notice be published in the newspaper of general circulation in Raleigh County to those same persons.
Believing the recommendation of the Mental Hygiene Commissioner to be appropriate, as it will allow this matter to proceed, it is hereby ORDERED the Circuit Clerk shall arrange for publication of notice for the above-referenced hearing in the newspaper of general circulation in
Raleigh County, and the alleged Protected Person shall be identified therein as “K.S.P.”
