TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 10, 2013, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5053, at Page 2492, Joshua A. Stewart, Sr. and Audarene Walls and Pamela Shelton did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

May 4, 2023, at 1:30 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:

Being certain property located in the Trap Hill District of Raleigh County, West Virginia and is more particularly described as follows:

THAT certain parcel of land located near Glen Daniel, Trap Hill District, Raleigh County, West Virginia, and is more particularly described as follows:

BEGINNING at a roof bolt (found) on the south east right of way line of WV State Route 3, said point being a corner to Arbutus Clay; thence S 43 30′ E with the Arbutus Clay line 259.12 feet to a roof bolt (found) on the north west right of way line of the Chesapeake and Ohio Railway Company; thence S 47 03′ W with the right of way line of the Chesapeake and Ohio Railway Company 133.27 feet to a rebar and cap (set), said rebar and cap is a corner to Joseph L. Cook; thence N 45 57′ W with the Joseph L. Cook line 245.79 feet to an iron pin (set) in the south east right of way line of WV State Route 3; thence N 41 37′ E with the right of way line of WV State Route 3 144.31 feet to the place of BEGINNING and containing 0.80 acres, more or less. All of which is shown on a map prepared by Jerry W. Cantley, P.S. dated August 14, 2003 to be attached hereto and read as a part hereof.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 620 Coal River Road, Glen Daniel,, WV 25844.

AND BEING the same real estate which was conveyed to Joshua A. Stewart, Sr., Audarene Walls and Pamela Shelton by Deed dated October 9, 2013, from Chad E. Henderson and Brittany L. Henderson, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5053, at Page 2491.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
