The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 11, 2021, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 1045, at Page 524, Arnold Douglas Maddy and Billie Jo Maddy did convey unto Teays Valley Trustee, LLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Plateau District, Fayette County, West Virginia, and more particularly described as follows:

Land situate, lying, and being in Fayette County, District of Plateau West Virginia, to-wit:

The land referred to herein below is situated in the County of Fayette, State of WV, and is described as follows: The following described tracts or parcels of surface land, together with the improvements thereon, appurtenances thereunto belonging and rights incidental thereto, situate in Plateau District, Fayette County, West Virginia, and being more particularly described as follows, to-wit:

Beginning at a set stone, spruce-pine and chestnut on the bank of plum orchard creek corner to Rachel Thompson, thence down said creek as it meanders N 46 W 186 feet, S 59 W 170 feet, N 77-45 W 106 feet to a holly and white oak on bank of said creek, thence continuing down said creek N 87-10 W 164 feet to a holly on bank of creek, thence leaving said creek N 10-30-W 518 feet to an ash by a branch, thence up said branch N 3-20 E 128 feet to a white oak sapling, thence N 20 E 258 feet to a stake, thence N 7 E 150 feet to a white oak and poplar, thence leaving the branch N 69-45 E 452 feet to two chestnut oaks on ridge, thence up said ridge N 67-40 E 320 feet to a stake in line between Jake Thompson and W.F. Thompson lands, thence with said line S 2 E 160 feet to a Black Jack Stump, thence S 7 W 436 feet to a stake corner to Jake Thompson and Rachel Thompson tracts, thence S 7 W 64 feet to a stake, thence S 16-30 W 870 feet to the beginning and containing 22.6 acres and beginning at a stake in plum orchard creek and corner to Gracie Berry Property; thence, with Gracie Berry line N 6-55 W about 80 feet to a cluster of sourwoods; thence N 6-55 W, 45 feet to a stone on south side of county road; thence, with county road N 57-00 E 124 feet to a stone; thence N 72-15 E 81 feet to a stone; thence, S 83-49 E 82 feet to a stone; thence, S 64-25 E 64.4 feet to a stone; leaving and crossing county road and continuing with grade berry line N 5-12 E 1283 feet to a stone corner to Gracie Berry and in line of original survey of Grade Berry Property; thence with original line N 47-00 E 1258 feet to a stone (originally a stake), Dogwood and Chestnut oak pointers on the north line of the original survey; thence leaving the original line S 35-00 E 452 feet to a small black pine and stake; thence, S 2-00 E 298 feet to a stake in line between Jake Thompson Tract and W.F. Thompson tract at a point where Robert Lively line intersects with above-mentioned line; thence, S 67-04 W 320 feet with Robert Lively line to two chestnut oak sprouts on a ridge; thence, S 69-45 W 452 feet to a small white oak and poplar on bank of branch; thence, down the branch S 7-00 W 150 feet to a stake; thence, S 20-00 W 258 feet to a white oak sapling; thence, S 3-20 E 128 feet to an ash by branch; thence, S 10-30 E 518 feet to a holly on bank of plum orchard creek; thence, down said creek as it meanders to the place of beginning and containing 29-3/4 acres, more or less (county road excluded).

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 63 Plum Orchard Lake Road, Scarboro, WV 25917.

AND BEING the same real estate which was conveyed to Arnold Douglas Maddy and Billie Jo Maddy by Deed dated February 20, 2019, from Zachary William Maddy, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 774 at Page 220.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
