Notice is hereby given that RESILIENT MINING LLC, 1330 SOUTH MAYO TRAIL (BOX 12), 3RD FLOOR SUITE 302, PIKEVILLE, KY 41501 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 228.6 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number S300311 to surface mine by contour, auger, highwall mining methods, construct haulroads and disposal of coal refuse in the Peerless, No. 2 Gas, Lower Cambells Creek, Powellton, Eagle A, Eagle, Little Eagle and associated riders and splits thereof seam of coal. The operation is discharging into Unnamed Tributaries of/and Dempsey Branch, Unnamed Tributaries of/and Cassidy Branch, All of Laurel Creek of New River of Kanawha River and is located 4.2 miles, northwest of Lochgelly in New Haven District of Fayette County, Longitude 81o11’16” and Latitude 38o3’33” (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until June 17, 2023, or thirty (30) days from the date of final publication.
