NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 30, 2018, executed by Borrower, Russell Parker, Jr., to Paul O. Clay, Jr. & Brandon Steele, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 1001, at Page 364. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 130 Cafego Rd., Scarbro, WV 25917. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 16, 2023. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

31st day of May, 2023
at 12:00 p.m.

BEGINNING at an iron rod on the north side of Oak Street (said) iron rod being located 15 feet from the center of said Oak Street, and being the common front corner of Tract “A” and Tract “B”, and being witnessed as follows: The southeastern and front corner of the brick dwelling now being constructed on the lot here described bears N 63-05` W a distance of 78.0 feet, and the northeastern and back corner of said brick dwelling bears N 46-35` W a distance of 92.50 feet and leaving said Oak Street and running N 2-39` W 151.00 feet to an iron pin; thence leaving Tract “B” and with a new line through Tract “A” N 78 11 W 137.15` feet to an iron pin on line of Edmonds and Thompson; thence with same and western line of Tract “A” S 1-48` E 170.60 feet to a fence post on the northern side of said Oak Street; thence leaving Edmonds and Thompson and with the northern side of said Oak Street N 89-20` E 135.00 feet to the place of beginning, and containing 0.483 of an acre. And being the same property conveyed unto the parties if the first part herein by deed of, Fred C. Burns, et ux, dated the 30, day of July 2018, recorded in Book 767, Page 589 in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument. This instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deeds in the chain of title to the above described real estate.

Being the same property conveyed to Russell Parker, Jr. by the Deed dated July 30, 2018 and recorded in Deed Book 767 at Page589 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
