NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 13, 2007, executed by Borrowers, Gregory Blankenship and Teresa Blankenship, to Richard A. Pill and David D. Pill, Either of Whom Act Of, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5027, at Page 2840. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 105 Ocala Ct, Beaver, WV 25813. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 24, 2020, of record in the Clerk’s Office in Book 5071, Page 3252. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

at 11:15 a.m.

Being that certain property located in Shady spring District, Raleigh County, West Virginia, and shown and designated as Parcel No. Four (4) on that certain map entitled “Offconveyances, A.P. Lilly Rome Tract, Shady Spring District, Raleigh County, W.V. Scale 1″ = 50′ P.H. Wilson, C.E. April 8, 1954,” which said map is of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia in Deed Book 335 at page 487, said lot or parcel of land is more particularly bounded and described as follows, to-wit:
Beginning at a 5/8″ rebar and cap set at the southeast corner to Parcel 4 and southwest corner to Parcel 5 and proceeding thence with said Parcel 4, S. 57 57′ 43″ W., 156.61 feet to a fence post found at southwest corner to Parcel 4; thence continue with said Parcel 4, N. 33 01′ 57″ W., 80.08 feet to the corner of Parcels 2, 3, and 4, being distant, N. 33 01′ 57″ W., 1.00 feet from an iron pipe found; thence with said Parcel 2 and 4, N. 51 57′ 00″ E., 144.37 feet to an iron pipe found on line Parcel 2 and at Northwest corner of Alley (Ocala Court per Tax map); thence with said Alley, S. 33 00′ 25″ E., 11.00 feet to the southwest corner of said Alley; thence N. 55 54′ 04″ E, 14.00 feet to a rebar found, corner to Parcel 5 and 4; thence, with said Parcel 5 and 4, S. 32 12′ 12″ E., 84.70 feet to the point of Beginning together with the right to the joint use of an eleven foot Alley leading from property herein described to the Blue Jay Road. Said tract contains 0.315 acres, more or less as shown on a plat prepared by SCS Surveyors, dated the 19th day of June, 2006.

Being the same property conveyed to Gregory Blankenship and Teresa Blankenship by the Deed dated June 13, 2007 and recorded in Deed Book 5027 at Page 2838 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
