TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 10, 2014, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 939, at Page 454, Robert L. Peyton and Katherine D. Peyton did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley District, Fayette County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of land situate in the Village of Boomer, Valley District, Fayette County, West Virginia, and being Lot No. 101-A, Section One, Boomer Addition, as shown upon the map entitled “Map Showing Boomer Addition, Section One, Electro Metallurgical Company, Falls District, Fayette County, W. Va., EBL-101”, dated August 25, 1955, and recorded in the Office of the Clerk of the Fayette Commission, Fayette County, West Virginia, in Map Book 14, at Pages 5 and 6, and being the same property conveyed to Margaret H. Kemper and Betty B. Mays, her mother, by Terry E. Fleming and Teena M. Fleming, his wife, by Deed dated the 21st day of October, 1977, of record in the aforesaid Clerk’s Office in Deed Book 362, at Page 519.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 101 A Street, Boomer, WV 25031.

AND BEING the same real estate which was conveyed to Robert L. Peyton by Deed dated August 23, 1986, from Leo Mays, Elizabeth Mays, Betsy S. Langton and Richard Langton, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 445, at Page 663.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
