The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 19, 2020, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5071 at Page 8835, Mary E. Bias did convey unto Robert Dunlap, Esq. PLLC, DBA Dulap & Associates, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
The surface only of that certain lot or parcel of land, together with the improvements thereon and appurtenances thereunto belonging, situate in the City of Beckley, Raleigh County, West Virginia, and more particularly bounded and described as follows:
Beginning at a stake which bears N 78 11′ W 30 feet from the northwest corner of cemetery in line of Ford Addition thence with line of Ford Addition N 78 11′ W 134 feet to the east line of an alley in the Ford Addition; thence leaving line of Ford Addition and with the east line of said alley S 11 49′ W 60 feet; thence leaving the alley S 78 11 E 134 feet to a stake 30 feet from the cemetery line; thence parallel to said line and 30 feet therefrom N 11 49? E 60 feet to the beginning, heretofore designated and erroneously stated as N 11 40′ 60 feet to the place of beginning, in the previous deed in the chain of title, containing 8,400 square feet.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 116 Ford Street, Beckley, WV 25801.
AND BEING the same real estate which was conveyed to Mary E. Bias, by Deed dated June 17, 2020, from Margaret Lou Phillips, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5071 at Page 8834.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
