NOTICE OF PUBLIC HEARING ON THE
CITY OF BECKLEY BOND
ORDINANCE

A public hearing will be held on the following entitled-Ordinance at a regular meeting of the Council of the City of Beckley (the “City”) to be held on Tuesday, November 24, 2020, at 6:30 p.m., at City Hall, Beckley, West Virginia, and at such hearing any person interested may appear before the Council and present protests, and all protests and suggestions shall be heard by the Council and it shall then take such action as it shall deem proper in the premises upon an Ordinance entitled:

ORDINANCE AUTHORIZING THE REFUNDING OF THE ISSUER’S OUTSTANDING STORMWATER REVENUE BONDS, SERIES 2010 A AND THE FINANCING OF THE COST THEREOF, NOT OTHERWISE PROVIDED, AND PAYING COSTS OF ISSUANCE AND RELATED COSTS, THROUGH THE ISSUANCE OF STORMWATER REFUNDING REVENUE BONDS, SERIES 2020 A OF THE CITY IN THE AGGREGATE PRINCIPAL AMOUNT OF NOT MORE THAN $1,350,000; PROVIDING FOR THE RIGHTS AND REMEDIES OF, AND THE SECURITY FOR, THE REGISTERED OWNERS OF SUCH BONDS; AUTHORIZING THE EXECUTION AND DELIVERY OF ALL DOCUMENTS RELATING TO THE ISSUANCE OF SUCH BONDS AND AUTHORIZING THE SALE AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH BONDS AND ADOPTING OTHER PROVISIONS RELATING THERETO.

The above quoted title of the Ordinance describes generally the contents thereof and the purposes of the Bonds contemplated thereby. The City contemplates the issuance of the Bonds described in the Ordinance. The proceeds of the Bonds will be used to (i) to refund the Issuer’s Series 2010 A Bonds; (ii) to fund the Seires 2020 A Bonds Reserve Account; and (iii) to pay certain costs of issuance of the Bonds and related costs. The Bonds are payable solely from revenues to be derived from the ownership and operation of the stormwater system of the City. No taxes may at any time be levied for the payment of the Bonds or the interest thereon.

The above-entitled Ordinance was adopted by the Council of the City of Beckley on November 10, 2020. A certified copy of the above entitled Ordinance is on file with the City for review by interested parties during regular office hours.

Due to the public health impact of the Coronavirus (COVID-19) Pandemic, and out of concern for the health and wellbeing of the city employees, members of the common council and members of the public, the regular meeting for common council will be held via a WebEx Event. The public may join the meeting from their computer or phone using the weblink or phone number provided on the City’s webpage or Facebook page the day of the council meeting.

Following the public hearing, the Council intends to enact the Ordinance upon final reading.
