NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated July 29, 2013, from James William Bowes to Sharon Borich and Lynn Mayberry, Trustees, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 1260, at page 745, securing a promissory note in the principal amount of $179,500.00 payable to New Peoples Bank, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by New Peoples Bank, Inc., the undersigned Successor Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on December 3, 2020 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly described as follows:
PARCEL NO. 1:
(Tax Map 18, Parcel 70.1)
“All that certain lot or parcel of land as shown on a MAP SHOWING SURVEY OF A PARCEL OF LAND COMPRISING 0.37 ACRES TO BE CONVEYED TO JOHN M. HARMON, III AND JUDY A. HARMON, HUSBAND AND WIFE, BY JAMES W. BOWES, SITUATE ON W.VA. SECONDARY OF BRUSH CREEK BEAVER POND DISTRICT, MERCER COUNTY, WEST VIRGINIA DATE 09-18-78 SCALE 1″ = 20′ VEL. MM-I P-22 NO. 9-1878 HAMILTON SHARPE, BOX 927, HINTON, W.VA. PHONE 466-2511 TAX MAP 2, SAID MAP RECORDED WITH DEED IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF MERCER COUNTY, WEST VIRGINIA, IN DEED BOOK 568, AT PAGE 644,” and of record as Microfilm Plat No. 6870.
And being the same real estate conveyed unto James W. Bowes by deed dated July 18, 2013 from New Peoples Bank, Inc., a corporation, of record in the aforesaid Clerk’s office in Deed Book No. 993, at page 752.
PARCEL NO. 2: (Tax Map 18, Parcels 69.1 and 70)
Tract No. 1:
“Beginning at an iron pin in the northern right of way line of West Virginia State Highway, Route No. 23, leading from Brush Fork to Littlesburg, the said iron pin being located at a distance of 685 feet from the southwest corner of the J. Herman Bowes and Lula M. Bowes tract; thence from said beginning point, N. 42 degrees 50′ W. 307.0 feet to an iron pin at a fence line; thence N. 60 degrees 40′ E. 231.4 feet on an iron pin; thence S. 37 degrees 00′ E. 260.3 feet to an iron pin in the northern right of way line of said West Virginia State Highway; and thence along and with said northern right of way line of said highway, S. 48 degrees 20′ W. 197.7 feet to the point of beginning, containing 1.38 acres.”
Tract No. 2:
“All of that certain lot or parcel of real estate on the waters of Brush Fork Creek, Beaver Pond District, Mercer County, West Virginia, known and designated as Lot No. 34 as shown by a map thereof which bears the legend “BOWES FARM SUBDIVISION, A 60 ACRE FARM LYING ON THE WATERS OF BRUSH FORK CREEK, BEAVER POND DISTRICT, MERCER COUNTY, DATED MAY 12, 1959,” which said map is filed in the office of the Assessor of Mercer County, West Virginia, in Map Book 2, at page 109.”
And being the same real estate conveyed to James W. Bowes, by deed dated October 10, 1972, from Sarah B. Armbrister, et al, which deed is of record in the aforesaid Clerk’s office in Deed Book No. 488, at page 742.
Terms of the sale: cash on date of sale.
