In execution of a certain Deed of Trust dated September 29, 2006, in the original principal amount of $49,200.00 recorded in the Clerk’s Office, Circuit Court for Tazewell County, Virginia, in Book 0983 at Page 0255 as Instrument No. 060004794 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Tazewell County, 101 Main Street, Courthouse Building, Tazewell, Virginia on December 7, 2020, at 11:30 AM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THOSE CERTAIN LOTS OR PARCELS OF LAND, TOGETHER WITH THE APPURTENANCES THEREUNTO BELONGING, SITUATE SOUTH OF THE TOWN OF RICHLANDS, IN TAZEWELL COUNTY, VIRGINIA, AND BEING DESIGNATED, KNOWN AND DESCRIBED AS LOTS NOS. FOUR (4) AND FIVE (5) AND ONE-HALF OF LOT NO. THREE (3) IN SECTION NO. 5, ON A PLAT OF LOTS ENTITLED, “MAP OF PURCELL ADDITION TO THE TOWN OF RICHLANDS, VA.”, AS SHOWN BY A PLAT, WITH CERTIFICATE BY G.W. DALTON AND OTHERS, DATED THE 5TH DAY OF JUNE, 1954, AND OF RECORD IN THE CLERK`S OFFICE OF THE CIRCUIT COURT OF TAZEWELL COUNTY, VIRGINIA, IN DEED BOOK 228, PAGE 140, AND IN PLAT BOOK NO. 1, PAGE 149, AND THE SAID PART OF LOT NO. THREE (3) WHICH IS HEREBY CONVEYED BEING THE NORTHERN ONE-HALF OF LOT NO. THREE (3) FRONTING 12 ½ FEET ON CIRCLE DRIVE STREET RUNNING THE ENTIRE DEPTH OF LOT NO. THREE (3), SAID ONE-HALF OF LOT NO. THREE (3) ADJOINING THE ENTIRE DEPTH OF LOT NO. FOUR (4); REFERENCE TO WHICH SAID MAP AND CERTIFICATE IS HERE MADE FOR A MORE PARTICULAR DESCRIPTION OF THE PROPERTY HEREBY CONVEYED. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
