REPLACEMENT PROJECT
The Armstrong Public Service District is requesting Bids for the construction of the following Project:
Powellton Water Tank
Replacement Project
Sealed Bids for the construction of Contract No. 1 will be received at the Armstrong Public Service District located at 826 Armstrong Creek Road, or P.O. Box 156, Kimberly, WV 25118 until 2:00 p.m. local time on September 5, 2023, at which time the bids received will be opened and publicly opened and read.
The Project includes the following Work:
Contract No. 1 – Furnishing all materials, labor, and necessary items for the construction and installation of the 137,000-gallon water storage tank, valve vault, telemetry, pile and lagging retaining walls, fencing, site access road, decommissioning the existing tank, connection to the existing system, and all the related appurtenances.
Bids shall be on a lump sum and unit price basis as indicated in the Bid Form.
Contract Times for Contract: 120 calendar days to substantial completion and 150 calendar days to complete work ready for final payment. Contractor shall pay Owner $1,000 for each day that expires after the time (as duly adjusted pursuant to the Contract) for Substantial Completion until the Work is substantially complete.
The Owner reserves the right to reject any or all bids.
The Armstrong Public Service District has tax exemption for all materials.

Bidders may examine and/or obtain the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 9:00 a.m. and 4:00 p.m.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of $200.00 for each set. Checks for Bidding Documents shall be payable to “E.L. Robinson Engineering Company”. Upon request and receipt of the document payment indicated above, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

A pre-bid conference for the Project will be held on August 16, 2023 at the Armstrong Public Service District Office at 11:30 a.m. Attendance at the pre-bid meeting is highly encouraged but is not mandatory.
Bidders on this work will be required to comply with the President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order No. 11375 which prohibits discrimination in employment regarding race, creed, color, sex or national origin.
Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. Bidders much comply with Title VI of the Civil Rights Act of 1964, the Copeland Anti-Kickback Act, the Contract Work Hours and Safety Act and the Drug-Free Workplace Provisions pursuant to West Virginia Code § 21-1D-5.
Contractors are required to comply with all laws pertaining to the federal wage rates issued in accordance with the Davis Bacon Act.
All bid must be accompanied by a Bid Guarantee Bond payable to the Owner for five percent (5%) of the total amount of the Bid or a Certified Check, Cashier’s Check, or Letter of Credit in the amount of not less than five percent (5%) of the Bid.
No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids.
All bidders are required to have a West Virginia contractor’s license per Section 21-11-11 of the West Virginia Code. A Contractor’s License Number is to be included on the bid submission.
DBE Requirements
Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
Pursuant to West Virginia Code § 5-22-2, requirements stated in the advertisement for bids and the bid form may not be waived by any public entity.
