TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 26, 2017, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2017007235, in Book No. 983, at Page 460 and re-recorded in Document No. MOD 201900004990, in Book No. 1011, at Page 728, Matthew L Davis and Brandi M Davis did convey unto Paul O. Clay, Jr. & Brandon Steele, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on

September 25, 2023 at 2:30 PM

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:

Tract I: All that certain real estate situate and being in or near the City of Oak Hill, in Fayetteville District of Fayette County, West Virginia, known and designated as Lots No. One Hundred Twenty-Two and One Hundred Twenty-Three (122 and 123) as shown on a revised map marked “South Hills Subdivision” made by Bennett-Naeve-Thomas Engineering Company, Oak Hill, West Virginia, dated February 21, 1958 and of record in the Office of the Clerk of the County Court of Fayette County, West Virginia, in Map Book 11, at Page 53, together with right to use in common with the other owners of lots, the streets alleys and ways as shown on said map.
Tract II: A triangular parcel, part of Lot No. 124 of the South Hills Subdivision to the City of Oak Hill, and described as follows: Beginning at an iron pin situate on the southern side of Willowwood Road, and same being common corner to Lots No. 123 and 124; thence leaving said road and with common line of Lots 123 and 124, S 1-46′ W 50 feet; thence with a new line diagonally across the northwest corner of Lot 124, N 43-14′ W 70.71 feet to an iron pin on aforesaid road; thence with same, S 88-14′ E 50 feet to the point of beginning, and containing 1250 square feet.
And being the same property conveyed unto the parties of the first part herein by deed of Henri Anna Olson and Jackie Lee Holt, (aka Jack Holt) dated the 4 day of May, 2017, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument.
This instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deeds in the chain of title to the above-described real estate and more particularly those certain General Reservations and Restrictions as set out on that certain Deed dated October 28, 1963, and recorded in Deed Book 252, at Page 249.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1153 Country Club Rd, Oak Hill, WV 25901.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
