NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated July 27, 2007, from Josh A. Phillips and Tonyia A. Phillips to Frederick A. Jesser, III, and Bonnie Lee, Trustees, of record in the office of the Clerk of the County Commission of Fayette County, West Virginia in Trust Deed Book No. 801, at page 576, and Trust Deed Book No. 802, at page 314, securing a promissory note in the principal amount of $56,333.14, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Fayette County Courthouse in Fayetteville, West Virginia on December 14, 2020 at 1:15 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:

BEGINNING at a point in the center of White Oak Branch on the northern right-of-way of Route 61/8 corner to Jeremy Phillips 14.859 are tract and Jeremy Phillips 1.196 acre tract, of which this is a part; thence laving the 14.859 acre tract and with the northern right-of-way of Route 61/8 for the following three courses and distances, North 76-21′-45″ West, a distance of 33.83 feet; thence North 75-19′ 51″ West, a distance of 44.40 feet; thence North 81-15′-53″ West, a distance of 22.43 feet to a 5/8″ rebar with cap (set); thence leaving Route 61/8 and with a new line through the 1.196 acre tract, North 18-00′-00″ West, a distance of 158.79 feet to a 5/8″ rebar with cap (set); thence continuing with a new line, North 63-56′-53″ East, a distance of 87.06 feet, to a 5/8″ rebar with cap (set) on the division line between the 14.859 acre tract and the 1.196 acre tract, said rebar bears South 18-00′-00″ East, a distance of 84.24 feet from a 1/2″ rebar (found); thence with said division line, South 18-00′-00″ East, a distance of 222.78 feet to the beginning, containing 0.376 acres, more or less, as shown on a plat recorded in the aforesaid Clerk’s office. All bearing based on Deed meridian (Deed Book 91, Page 130- Tract No. 2).

Together with an easement and right-of-way over, across and through the residue of Pamela K. & Jeremy A. Phillips property for the purpose of installing, maintaining and repairing a water and sewer line.

Being the same property conveyed from Pamela K. Phillips, Attorney-in-Fact for Jeremy A. Phillips, and Pamela K. Phillips, his wife, to Josh A. Phillips and Tonyia A. Phillips, his wife, by Deed dated July 25, 2007, of record in the aforesaid Clerk’s office in Deed Book No. 632, at page 112.
Terms of sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
