Notice is hereby given that Panther Creek Mining, LLC, 250 W. Main Street, Suite 2000, Lexington, KY 40507 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 43.87 acres in order to add additional mining area for contour surface mining with auger/highwall mining and one (1) additional spoil storage fill in the Eagle and Little Eagle seam of coal. The proposed operation is discharging into Left Fork and Right Fork of Armstrong Creek and Unnamed Tributaries of/and Armstrong Creek of Kanawha River and is located 3.1 miles, southwest of Powellton in Valley District of Fayette County, Longitude 81deg. 19′ 39″ and Latitude 38deg. 02′ 49″.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until November 11, 2023, or thirty (30) days from the date of final publication.
