NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated August 15, 2005, executed by Estel John Shumate to Thomas S. Lilly and Phillip B. Ball, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1052, at page 409, Taylor W. Bohon having been substituted as Trustee pursuant to Substitution of Trustee, dated March 19, 2020, of record in the aforesaid Clerk’s office in Trust Deed Book 1402, at page 283, default having occurred in payment of the indebtedness secured by said Deed of Trust, and the undersigned Substitute Trustee having been requested to do so by Summit Community Bank, Inc., successor in interest to First Century Bank, N.A., owner and holder of the indebtedness secured by said Deed of Trust, the undersigned Substitute Trustee will offer for sale and sell at public auction on December 11, 2020, at 10:00 a.m., at the front entrance to the Mercer County Courthouse, 1501 Main Street, Princeton, Mercer County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:

PARCEL ONE: “all of that certain lot or parcel of land designated as Lot No. 5, Block 3, on a Map entitled, ‘Block 3, Boulder Park Subdivision, Princeton, Mercer County, West Virginia, Scale: 1″ – 50′, Sept., 1968, Bennett-Naeve-Thomas Engineering Company, 912 E. Main Street, Oak Hill, West Va.’, which is of record in the Office of the Assessor of Mercer County, West Virginia, in Map Book No. 3, at Page 16, now Micro-film Plat No. 4405.”

Said Lot No. 5, fronts 111.33 feet on the east side of Hillcrest Drive and extends back therefrom with Lot No. 4, on the southerly side for 152.73 feet and with Lot No. 6, on the northerly side for 150.85 feet, being 108.00 feet on the rear.”

“This conveyance is made subject to all of the restrictions and conditions imposed in ‘Amended Declaration of Protective Covenants and Reservations Pertaining to Lots in Boulder Park Subdivision, Block No. 3, in East River District, Mercer County, West Virginia’, dated October 22, 1968, and of record in said Clerk’s Office in Deed Book No. 447, at Page 227.”

PARCEL TWO: “all that certain lot or parcel of land in East River District, Mercer County, West Virginia, designated as ‘B’ shown upon a Map bearing the legend, ‘AMBER HILLS (Sections 1 & 2), MAP SHOWING PROPERTY ANNEXED TO THE CITY OF PRINCETON NOV. 9, 1981, PRINCETON, WEST VIRGINIA, DANA PETTREY AND ASSOCIATES, Box 641, Athens, West Virginia, REVISED 6-1-82, DATE: 3-15-82, SCALE: 1” = 100’, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Microfilm Plat No. 8189, and more particularly bounded and described as follows:

“BEGINNING at a point in the western outer boundary line of said Subdivision at the common corner of Lots ‘A’ and ‘B’ as shown upon said Map; thence N. 29 37′ 28″ W. 108.0 feet to a point, the common corner of Lots ‘B’ and ‘C’; thence with the dividing line between Lots ‘B’ and ‘C’, N. 64 29′ 32″ E. 83.82 feet to a point; thence S. 18 11′ 25″ E. 107.24 feet to a point, the common corner of Lots ‘A’ and ‘B’; thence with the dividing line between Lots ‘A’ and ‘B’, S. 63 14′ 32″ W. 62.42 feet to the point of BEGINNING, containing 7,824 square feet, more or less.”

“The conveyance of the Amber Hills lot is subject to the restrictions set forth in Deed Book 611, at page 577.”

“This conveyance is made expressly subject to all pertinent restrictions, reservations, and easements of record.”

TERMS OF SALE: Ten percent (10%) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned Substitute Trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
