Notice is hereby given that RESILIENT MINING LLC, 1330 SOUTH MAYO TRAIL (BOX 12), 3RD FL SUITE 302, PIKEVILLE, KY 41501 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 591.72 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number S301601 to Coal Surface Mine in the No. 2 Gas, Big Eagle, Eagle A, Little Eagle, Peerless, and Powellton seam of coal. The operation is discharging into unnamed tributaries of/and Loop Creek, unnamed tributaries of/and Open Fork of Loop Creek, unnamed tributaries of/and Taylor Branch of Loop Creek of the Kanawha River and is located 2.3 miles, east of Kincaid in Valley District of Fayette County, Longitude 81o13’27” and Latitude 38o2’8” (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until December 9, 2023, or thirty (30) days from the date of final publication.
