The object of the above-entitled action is to quiet title and partition certain real property located in Fayette, County, West Virginia, and for an accounting and the equitable distribution of profits flowing from the subject property, as is more particularly described in the Complaint filed herein.
It appearing by Affidavit filed in this action that JEREMY EDWARDS is a resident of Fayette County, West Virginia; that the Plaintiff unsuccessfully attempted to obtain service of the Summons and Complaint upon the Defendant via private process server, and that the Plaintiff has used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the address or whereabouts of Defendant but has not been successful in so doing;
It appearing by Affidavit filed in this action that interested parties JAMES R. CAMPBELL and DEBORAH L. CAMPBELL are residents of Fayette County, West Virginia; that the Plaintiff unsuccessfully attempted to obtain service of the Summons and Complaint upon these interested parties via certified mail, and that the Plaintiff has used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the address or whereabouts of these interested parties but has not been successful in so doing;
It is therefore ORDERED that JEREMY EDWARDS, JAMES R. CAMPBELL, and DEBORAH L. CAMPBELL appear and serve upon Michael C. Cardi, Bowles Rice LLP, counsel for Plaintiff, whose address is 125 Granville Square, Suite 400, Morgantown, West Virginia, 26501, a response or other defense to the Complaint heretofore filed in this action within 30 days after the date of first publication of this notice. Otherwise, the Court may render a judgment of default against Defendant JEREMY EDWARDS at any time thereafter, thereby granting the relief requested by Plaintiff in the Complaint.
A copy of said Complaint can be obtained from the Office of the Clerk of the Fayette County Circuit Court, Fayette County Courthouse, 100 North Court Street, Fayetteville, West Virginia 25840.
