NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by the virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 13, 2007, executed by the Borrowers, Mark Wade and Robin Wade, to Carl W. Roop, the Trustee, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 795, at Page 514. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Rt. 82 Box 75, Winona, WV 25942, and, upon information and belief, may also be known as 6460 Lansing Edmond Rd., Winona, WV 25942. Pill & Pill, PLLC was appointed as Substitute Trustee by the SUBSTITUTION OF TRUSTEE dated January 4, 2024, of record in the Clerk’s Office in Book 1090, at Page 413. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia on the following date: February 29, 2024, at 2:45 p.m. All that tract or parcel of land, together with any improvements thereon, rights, incidental thereto any appurtenances thereunto belonging, situate in the Community of Winona, New Haven District, Fayette County, West Virginia, and being more particularly described as follows: Beginning at a ½ inch iron rod set in concrete on the east right of way line of West Virgina Route 82; thence leaving Route 82 N 89-24 E 148.38 feet to a 1/2 inch iron rod set on the west side of a dirt road; thence crossing said dirt road S 00-35 W 109.01 feet to a nail in a lead plug set in the northeast end of a large rock, a 1/2 inch iron rod set in concrete at the southeast corner of a frame building on the west side of said road bears N 58-28 W 31.05 feet; thence S 16-43 W 190.41 feet to a 1/2 inch iron rod set in concrete; thence N 85-44-40 W 112.47 feet to a 1/2 inch iron rod set in concrete on the east right of way line of aforementioned Route 82; thence with said right of way line N 04-00 E 282.22 feet to the beginning and containing 0.925 acres, more or less, and designated as Winona Lot No. 11 on a map or plat attached hereto and made a part of this description. All bearings taken from the magnetic meridian have a declination of 7 degrees 35’ West. And being part of The John Nuttall Estate’s Tract No. 12 as found of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Order Book 20, at Page 155. And being the same real estate conveyed unto Mark Wade and Robin Wade by the Deed dated the 13th day of April, 2007, from Charles A. Small, and recorded in the Office of the Clerk of the county Commission of Fayette County, West Virginia, in Deed Book 630, at Page 347. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-2-1. 3) The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after foreclosure sale will be deeded to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the sate of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sake, Pill & Pill, PLLC, Substitute Trustee
