NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated April 30, 2014, from Janey L. Adkins to Stephen M. Feola, as trustee, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5055, at page 2046, the undersigned trustee will offer for sale at public auction on February 28, 2024, at 11:00 a.m., at the Main Street entrance of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, the surface of that parcel of land siutate on the waters of Big Beaver Creek, Shady Spring District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:

BEGINNING at a set stone found 0.86 feet west of a fence corner which is approximately N. 11E 18’ E. 40.00 feet from the center line of Upper Left Fork Road; thence with the adjoiner=s line S. 11E 17’ 52.2” W. 33.67 feet to the northeast right of-way line of said road; thence running with said road, 15 feet northeast of the center line and parallel to the center line of the road the following courses and distances: N. 58E 12’ 08.3” W. 43.96 feet, N. 50E 53’ 17.7” W. 31.12 feet, N. 46E 12’ 51.5” W. 28.89 feet, N. 36E 38’ 39” W. 53.69 feet, N. 33E 46’ 43” W. 29.67 feet, and N. 30E 22’ 31’’ W. 63.25 feet; thence leaving said road and cutting through the lands of J. Dott Lilly N. 70E 35’ 27.9” E. 185.06 feet to a fence post; thence with J. Dott Lilly and the adjoiner=s line S. 1E 21’ 31.1” W. 213.62 feet to the beginning, and containing 0.57 acres, more or less.

And being the same property conveyed unto the Janey L. Adkins, formerly known as Janey L. Cheselka, by two (2) deeds, the first deed being dated the 22nd day of June, 2001, which deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5004,a t page 8556, and by Quitclaim Deed from Jerry L. Cheselka dated January 9, 2003, which deed is recorded in the aforesaid Clerk’s Office in Book 5008, at pag4e 7962.

This conveyance is subject to all reservations, exceptions, limitations, restrictions, and conditions contained in all former conveyances of said property or any part thereof, excepting those pertaining to race, color, or creed.

The deed of trust states that the address of this real estate is 230 Mountain Lane, Shady Spring, West Virginia 25918.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated December 28, 2023, of record in said Clerk’s Office in Book 5082, at page 633.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by deed without any warranty, expressed or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
