Activity:
To operate and maintain an existing wastewater collection system and an existing 0.21 million gallons per day wastewater treatment plant. These facilities are designed to serve a population equivalent of approximately 3,500 persons in the Shady Spring Public Service District in the Cool Ridge/Flat Top areas and environs, and discharge treated wastewater through Outlet No. 001 to Laurel Creek, approximately 5.2 miles from its mouth, of Piney Creek of the New River. An antidegradation review has been conducted. Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6. Also, to accept non-domestic wastewater from Weathered Ground Brewery for subsequent treatment and disposal. To incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates. These land application site(s) meet all other regulatory standards and are identified as follows: Meador Wood Products Farm located at Ellison Ridge Road, Flat Top, WV. Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell. Also, the permittee may haul the sludge to the permittee’s main plant for further processing and disposal.

Continued compliance with the ordered requirements shall be attained in accordance with Order No. 9870 issued April 16, 2020, and any amendments thereto.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins March 05, 2024 and ends April 04, 2024.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
