TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 18, 2003, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 678, at Page 554, Eleesha D. Culver did convey unto Alan H. Larrick, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

April 15, 2024, at 2:00 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Oak Hill Corporation District, Fayette County, West Virginia, and more particularly described as follows:

The surface of that certain real estate located in CITY OF OAK HILL DISTRICT, FAYETTE COUNTY, WEST VIRGINIA, described as being the surface only of those two tracts of land located in the City of Oak Hill District of Fayette County, West Virginia, more particularly described as follows:

TRACT ONE:

BEING the surface only of ONE-HALF or 20 feet facing 2nd Street of LOT NO. SEVEN (7), BLOCK FOUR (4) The property hereby conveyed runs parallel to and joins Lot No. Eight (8), Block Four (4); as shown on a map entitled “MARBERRY PARK” situated in or near the East end of the City of Oak Hill, Fayette County, West Virginia in Map Book No. 6 at page 56, to which map reference is hereby made for a more complete and accurate description of the property hereby conveyed.

TRACT TWO:

BEING the surface only of LOT NO. EIGHT (8), BLOCK FOUR (4) as shown on a map entitled “MARBERRY PARK” situated in or near the east end of the City of Oak Hill, Fayette County, West Virginia, which map is recorded in the Office of the Clerk of the County Court of Fayette County, West Virginia in Map Book 6 at page 56, to which map reference is hereby made for a more complete and accurate description of the property hereby conveyed.

And being the same property acquired by Eleesha D. Culver, by Deed dated April 18, 2003, from Samantha C. Elswick (formerly Samantha C. Abner) and Scott A. Elswick, wife and husband, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 101 White Street, Oak Hill, WV 25901.

AND BEING the same real estate which was conveyed to Eleesha D. Culver, by Deed dated April 18, 2003, from Samantha C. Elswick formerly Samantha C. Abner and Scott A. Elswick, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 594, at Page 420.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
