NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Douglas E. Hayes, by that certain Deed of Trust dated July 23, 2008, executed by Borrower(s), Ted Durr, to Douglas E. Hayes, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1147, at Page 236. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 905 Front St, Princeton, WV 24740. The borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

28th day of January, 2021 at 11:30 a.m.

all of that lot or parcel of real estate as designated on a map to be recorded herewith: “`APPALACHIAN ENGINEERING & SURVEYING, INC. 212 COLLEGE AVE. – BLUEFIELD, W.V. 24701 PHONE 304-325-3481 MAP SHOWING PART LOTS 8 and 9 SECTION 132 FRONT STREET PRINCETON, MERCER CO., WV JOB NO. 97209 DATE: 6-26-97 REVISIONS: SCALE: 1” = 20` DRAWN BY: JSL CK`D BY: TN-, which map is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 12862, and which said property is more particularly bounded and described as follows: “`BEGINNING at a rebar in the southern right-of-way line of Front Street, said rebar located S 65 degrees 44 minutes W 143.40 ft. from the intersection of the southern right-of-way line of Front Street and the western right-of-way line of North 9th Street, said rebar also being the northeast corner of the herein described tract; thence through Lot 8 S 12 degrees 23 minutes E 75.00 ft. to an iron bar; thence along the northern line of a 9.0 ft. wide unopened alley S 80 degrees 23 minutes W 45.00 ft. to an iron bar; thence along the eastern line of a 9.0 ft. wide alley N 16 degrees 01 minute 47 seconds W 62.66 ft. to a nail in asphalt in the southern right-of-way line of Front St.; thence along said right-of-way N 65 degrees 44 minutes E 50.00 ft. to the point of BEGINNING and containing 3,236 square feet more or less, or 0.07 acre more or less.” AND BEING the same real estate conveyed unto the Party of the First Part herein, by Deed dated the 11th day of July, 2008, from Derondah Bradley Boothe, which Deed is intended to be recorded simultaneously herewith

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
