NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated June 11, 2007, executed by Chad E. Kirk to Brian Carr, Trustee, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 798, at page 295, Taylor W. Bohon having been substituted as Trustee pursuant to Substitution of Trustee, dated December 14. 2023, of record in the aforesaid Clerk’s office in Trust Deed Book 1090, at page 579, default having occurred in payment of the indebtedness secured by said Deed of Trust, and the undersigned Substitute Trustee having been requested to do so by Summit Community Bank, Inc., successor in interest to First Century Bank, N.A., owner and holder of the indebtedness secured by said Deed of Trust, the undersigned Substitute Trustee will offer for sale and sell at public auction on April 26, 2024, at 11:00 a.m., at the entrance of the Fayette County Courthouse, 100 N. Court Street, Fayetteville, Fayette County, West Virginia, the following described real estate, as follows:
All that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, being the surface of Lot 15, Block 9, Hidden Valley Estates located at #2 Coleman Circle, City of Oak Hill, Fayette County, West Virginia, more particularly described as follows:

Beginning at a pin located at the intersection of South Loop Drive and Coleman Circle; thence leaving South Loop Drive and with Coleman Circle, N. 05 14’ W., 80.00’ to a pin corner to Lot 5; thence leaving Coleman Circle and with the lot line of Lot No. 5, N. 82 42’ E., 75.00’ to a pin corner to Lots 5, 6 & 16; thence leaving Lots 5 & 6 and with the lot line of Lot 16, S. 05 14’ E., 80.00’ to a pin on the corner of Lot 16 and on the right-of-way of South Loop Drive; thence leaving Lot 16 and with South Loop Drive; thence S. 82 42’ W., 75.00’ to the point of beginning, containing 0.138 acres, more or less, as surveyed by Plateau Surveying & Mapping, Inc., Oak Hill, WV and shown on a map dated April 22, 1996, a copy of which is attached hereto and asked to be taken and read as a part hereof. This deed is made and accepted subject to all validly continuing reservations, restrictions, covenants, conditions, rights-of-way and easements made or contained in all prior deeds in the chain of title to the surface land herein conveyed.

TERMS OF SALE: Ten percent (10%) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
