An Ordinance to Approve an Increase in Sewer Rates

ORDINANCE TO:
Adopt Increased Sewer Rates

On February 4, 2020, during a regularly scheduled meeting, the Council of the Town of Athens approved the first reading of an Ordinance providing for the adoption of increased sewer service rates for the Town’s Sanitary Sewer operations.

Said Ordinance relates in part to the repairs to the Town’s Sewer Treatment Facility.

A public hearing will be held on February 18, 2020, at 6:00 p.m. at the Athens Town Hall. Anyone affected by the ordinance as it pertains to the project, or anyone objecting to the rates therein be present at the public hearing on February 18th wherein the hearing and second reading of the proposed Ordinance will occur.

The rates are attached to this notice.

APPLICABILITY
Applicable to entire territory served.

AVAILABILITY
Available for general domestic, commercial and industrial service.

METER RATES

First 2,000 gallons used per month 13.58 per 1,000 Gallons
Next 3,000 gallons used per month 12.72 per 1,000 Gallons
Next 5,000 gallons used per month 11.90 per 1,000 Gallons
Next 15,000 gallons used per month 11.51 per 1,000 Gallons
Over 25,000 gallons used per month 10.65 per 1,000 Gallons

MINIMUM CHARGE
The above schedule is subject to a monthly minimum charge based on the size of the meter as follows: No bill will be rendered for less than the following amount:
Minimum Bill 27.16 per month

DELAYED PAYMENT PENALTY
The above tariff is net. On all current usage billings not paid within twenty (20) days, ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to only be collected once for each bill where it is appropriate.

CONNECTION CHARGE
A fee of three hundred dollars ($300.00) will be charged for each new 4 inch connection to the system for providing such connection is less than ten (10) feet from the customer’s property line and the ditch line is unobstructed above and below the surface by any object natural or man-made, including but not limited to rocks, buildings, and DOH easements. In cases where such obstacles exist, additional fees to cover costs associated with overcoming such obstacles shall be assessed. Any connection 6 inches or larger will be performed at actual utility cost or as an alternate main line extension under the rules of the Public Service Commission of West Virginia, at the discretion of the customer.

LEAK ADJUSTMENT
$4.90 per 1,000 gallons. To be used when a bill reflects unusual consumption which can be attributed to eligible leakage on the customer’s side of the meter. This rate shall be applied to all such unusual consumption above the customer’s historical average usage.

SECURITY DEPOSIT
A security deposit of fifty ($50) dollars will be collected when application is made in accordance with West Virginia law.

BANK CHARGES
In cases where a check has been returned due to insufficient funds, the current bank charge will be imposed upon the customer not to exceed $25.00.

RECONNECTION CHARGE
When water service has been disconnected for non-payment of a bill or fraudulent use of water, water service shall not be restored until all past due water bills and penalties have been paid in full and a reconnection charge in the amount of forty dollars ($40.00) has been paid.

EFT OR CREDIT CARD PAYMENTS
A service charge will be imposed on EFT or Credit Card payments. Payment shall consist of actual charges from the financial institution for processing payment.

BILL REPRINT FEE
A charge of $1.00 will be assessed to customers who do not present the barcoded section of the bill provided by this Utility with payment.
